Terms of service

The agreement between you and PK Digital Marketing LLC covering accounts, live video, the Host Pass, acceptable conduct, arbitration and liability.

These Terms are a binding agreement between you and PK Digital Marketing LLC, a Michigan limited liability company ("we", "us", "our"), covering playeuchre.games and everything on it (the "Service"). By using the Service you accept them. If you do not accept them, do not use the Service.

Section 16 contains a binding arbitration agreement and a class action waiver that affect how disputes between us are resolved. You may opt out of it within 30 days. Please read it.

1. Who may use the Service

Free play: 13 and over. You may play euchre without an account if you are at least 13 years old.

Accounts and live video: 18 and over. You must be at least 18 to create an account, to appear on camera or microphone, or to purchase anything. Live audio and video are available only to adults.

The Service is offered only to users in the United States and Canada. We do not offer it elsewhere, and you may not use it from another country.

You may not use the Service if we have previously terminated your access, or if doing so would break any law that applies to you.

If you are using the Service on behalf of an organization, you confirm you are authorized to bind it, and "you" includes that organization.

2. What the Service is

playeuchre.games lets people play euchre in a web browser with each other and with computer opponents, with optional live audio and video at the table.

This is a game for entertainment. There is no wagering, no real money play, no purchasable chips or credits with cash value, no prize of monetary value, and no element of gambling. The only thing you can buy is a Host Pass, described in Section 5.

We may change, suspend or discontinue any part of the Service at any time.

3. Accounts

An account is optional and is required only for live video and for purchases. We identify accounts by email address and sign you in with a one-time code sent to that address.

You are responsible for the security of your email account, since anyone with access to it can sign in as you. Tell us promptly at hello@playeuchre.games if you believe someone else has accessed your account.

Accounts are for one person. Do not share, sell or transfer an account.

You must give accurate information, including an accurate date of birth. Giving a false date of birth to obtain access to live video is a material breach of these Terms.

4. Tables, links and other players

Starting a table creates a private table with a link. Anyone who has the link can join that table. Table links are not secret and are not protected by a password. Send a table link only to people you want at your table, and treat forwarding it the way you would treat forwarding any link.

Other people at your table are not under our control. We do not vet, screen or verify anyone. You interact with other players at your own risk, and you assume that risk. We are not responsible for the conduct of other users, whether online or offline.

5. The Host Pass, billing and automatic renewal

What it is. The Host Pass enables live audio and video at tables you host. One Host Pass covers everyone seated at that host's table. Free play, including play without video, does not require a pass.

Price and term. The Host Pass is $49.00 per year in US dollars, plus tax where required. Payment is handled by a third-party payment processor and is subject to that processor's terms. We do not receive or store your full card number.

Automatic renewal. Please read this paragraph carefully. The Host Pass renews automatically every year at the then-current price, charged to your payment method on the renewal date, until you cancel. You are giving us permission to charge you on a recurring basis. We will send a renewal reminder to your account email before each renewal, and we will give you advance notice of any price change before it takes effect.

How to cancel. You may cancel at any time, without contacting us and without explanation, from Manage billing on your account page, which opens our payment processor's customer portal. Cancelling stops future charges. Your pass keeps working until the end of the term you already paid for. If that link ever fails, email hello@playeuchre.games and we will cancel it for you.

Refunds are governed by our Refund Policy, which forms part of these Terms.

Free video games. Each account receives two free games with video before a pass is required. We may change or withdraw that allowance for future accounts.

Complimentary passes. We may grant complimentary passes at our discretion. They are never billed, carry no cash value, and we may revoke them at any time.

6. Acceptable use

You agree not to:

• harass, threaten, defame, stalk or abuse anyone, or encourage anyone else to;
• share content that is unlawful, hateful, sexually explicit, or that sexualizes or endangers a minor;
• transmit anything obscene or indecent on camera or microphone, or expose yourself;
• impersonate another person, or misrepresent your age or identity;
• use the Service for gambling, wagering or any exchange of money between players;
• cheat, use bots or automation against other players, exploit bugs, or interfere with fair play;
• scrape, crawl, reverse engineer, decompile, or attempt to derive source code;
• probe, scan, overload, disrupt or attempt to gain unauthorized access to the Service or its infrastructure;
• circumvent any access restriction, paywall, rate limit or security measure;
• resell, sublicense or commercially exploit the Service; or
• use the Service in violation of any applicable law.

We may remove content, end a table, suspend or terminate access, and report conduct to law enforcement, at our discretion and without notice.

7. Live audio and video

This section applies whenever the camera or microphone is on. Read it before you turn either on.

We do not record. We do not record, store, transcribe, caption, analyze or train any model on your audio or video. Audio and video pass through our video provider in real time to the other people at your table, and are not retained by us afterward.

We do not collect biometrics. We do not collect, capture, store, use, disclose, sell or profit from any biometric identifier or biometric information, including any scan of face geometry, any facial template, any voiceprint, retina or iris scan, or any similar measurement. We do not perform face detection, face recognition, emotion detection, age estimation or any comparable analysis on your audio or video. No such feature is enabled on our video rooms.

Other people can see and hear you. Everyone seated at your table sees and hears you when your camera and microphone are on, and so can spectators watching that table. Turn your camera or microphone off at any time using the controls at the table. Any player at a table may also mute another player's microphone or turn off their camera.

You must not record other people. You may not record, screenshot, stream, broadcast or otherwise capture another participant's image or voice without the express prior consent of every person captured. Many states and Canadian provinces require the consent of all parties to record a conversation, and recording without that consent may be a crime as well as a breach of these Terms.

We cannot prevent recording. Although we prohibit it and we do not provide any recording feature, we cannot technically prevent another participant from recording their own screen or pointing a camera at it. Do not say or show anything on camera that you would not want recorded. You accept this risk when you turn on your camera or microphone.

Your surroundings are your responsibility. You are responsible for what your camera and microphone capture, including other people, children, documents and anything else in the room. Do not turn on a camera where a person who has not agreed to be seen can be captured.

Consent. By turning on your camera or microphone you consent to your live image and voice being transmitted to, and seen and heard by, the other participants at your table for the duration of that session.

8. Chat and user content

You are solely responsible for what you type, say or show ("User Content"). You keep ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free licence to host, transmit and display it for the sole purpose of operating the Service. That licence ends when the content is deleted, except for copies retained in routine backups or where the law requires retention.

We do not pre-screen User Content and have no obligation to monitor it. We may remove any User Content at our discretion.

9. Reporting problems

To report abusive conduct, a safety concern, or content that violates these Terms, email hello@playeuchre.games with the table code and the time. We will review reports and act as we consider appropriate.

To report content you believe infringes your copyright, email the same address with the material at issue, its location, your contact details, a statement of good-faith belief, a statement that your notice is accurate, and your signature.

10. Availability

The Service is provided as it is and as it becomes available. It runs on third-party infrastructure and may be interrupted, delayed, degraded or discontinued. Games in progress are not guaranteed to be preserved. Live video depends on your network, your device and our video provider, and it may fail. We do not promise any level of uptime, and we do not promise that the Service will be uninterrupted, timely, secure or error free.

11. Third-party services

The Service depends on third-party providers for hosting, live audio and video, payments, email delivery, and analytics and advertising measurement. The categories are described in our Privacy Policy, which also explains how to ask us for the specific names. Those providers handle data under their own terms, and we are not responsible for third-party services.

12. Intellectual property

Euchre is a public game and its rules belong to nobody. The Service, its name, branding, artwork, design, text, and code are owned by PK Digital Marketing LLC and protected by intellectual property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial entertainment. All rights not expressly granted are reserved.

If you send us feedback, ideas or suggestions, you grant us an unrestricted, perpetual, irrevocable, royalty-free right to use them for any purpose without obligation to you.

13. Termination

You may stop using the Service at any time and may delete your account by emailing hello@playeuchre.games.

We may suspend or terminate your access at any time, with or without notice, including for breach of these Terms. On termination, your licence ends immediately. Sections 12 and 14 through 18 survive termination, along with any other provision that by its nature should survive.

If we terminate your account for a reason other than your breach, we will refund the unused portion of any Host Pass you have paid for.

14. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY. WE SPECIFICALLY DISCLAIM THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE CONDUCT OF OTHER USERS.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PK DIGITAL MARKETING LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR ANY OTHER THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY.

THIS INCLUDES, WITHOUT LIMITATION, ANY CLAIM ARISING FROM THE CONDUCT OF ANOTHER USER, FROM ANYTHING SEEN, HEARD, SAID OR SHOWN DURING A LIVE AUDIO OR VIDEO SESSION, OR FROM ANY RECORDING MADE BY ANOTHER PARTICIPANT IN BREACH OF THESE TERMS.

OUR TOTAL LIABILITY FOR ALL CLAIMS IN THE AGGREGATE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited by law.

16. Dispute resolution, arbitration and class action waiver

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to participate in a class action.

Informal resolution first. Before starting arbitration, you agree to email hello@playeuchre.games with a description of the dispute and the relief you want, and to give us 30 days to resolve it. We agree to do the same before bringing a claim against you.

Agreement to arbitrate. If we cannot resolve a dispute informally, you and we agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. An arbitrator, not a court, decides all issues, except that a court decides whether the class action waiver below is enforceable.

Class action waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is held unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies to all other claims.

Costs. For claims under $10,000 we will pay the filing, administration and arbitrator fees, unless the arbitrator finds the claim frivolous. Arbitration may proceed on documents alone, by telephone or video, or in person in Genesee County, Michigan, at your election.

Exceptions. Either of us may bring an individual claim in small claims court, and either of us may seek injunctive relief in court to protect intellectual property or to stop unauthorized access to the Service.

Your right to opt out. You may opt out of this arbitration agreement and class action waiver by emailing hello@playeuchre.games with the subject line "Arbitration Opt-Out", including the email address on your account, within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms and will not affect your use of the Service in any way.

17. Governing law and venue

These Terms are governed by the laws of the State of Michigan, without regard to its conflict of laws rules. For any dispute not subject to arbitration, you and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Genesee County, Michigan.

18. Indemnity

You agree to indemnify and hold harmless PK Digital Marketing LLC and its members, officers, employees and contractors from any claim, demand, loss, liability, damage, cost or expense, including reasonable legal fees, arising out of your use of the Service, your User Content, anything you transmit on camera or microphone, your breach of these Terms, or your violation of any law or of anyone else's rights.

19. Changes to these Terms

We may update these Terms. When we make a material change we will update the date at the top and, for account holders, notify the account email before the change takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Service and cancel any subscription.

20. General

These Terms and the documents they reference are the entire agreement between you and us about the Service. If any provision is held unenforceable, it is severed and the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. Nothing in these Terms creates a partnership, agency or employment relationship. We are not liable for any failure to perform caused by events beyond our reasonable control.
